Information on the transport contractor's obligations

Prohibition of transportation (interdiction order) as per § 63 Residence Act
According to § 63 (1) Residence Act a transport contractor may only transport foreigners to Germany if they are in possession of a required passport and a required residence permit (visa, residence permit, settlement permit).
In case of contravention of the legal prohibition of transportation (§ 63 (1) Residence Act) the Federal Ministry of the Interior or a body it has designated may prohibit transportation (§ 63 (2) Residence Act) and in case of violation may threaten a fine. The fine against the transport contractor shall be no less than 1,000 euros and no more than 5,000 euros for each foreigner whom he transports in contravention of a prohibition of transpor-tation (interdiction order).
The Federal Ministry of the Interior or a body it has designated may agree arrangements for implementation of the obligation specified in § 63 (1) (Memorandum of Understanding) with transport contractors.
